Argentinian Lawyer Accuses Lawmakers of Ignoring New Labor Code

Argentinian labor lawyer Julián De Diego, who participated in the drafting of the Labor Reform project, criticized lawmakers this evening, stating that they "never read the law." He argued that they lack sufficient elements to discuss or debate in Congress. "They are behind on this issue," he emphasized.

De Diego also harshly criticized the members of Congress: "They don't know the content, today I heard a lawmaker on the radio who was not aware." In an interview with the TN channel, the lawyer confirmed his participation in the "elaboration and drafting of the project," but admitted that "there were last-minute changes," such as the article that includes a salary cut if the worker suffers an "innocent" mishap, that is, an event beyond their will but outside the work environment.

"It is being said that in that case the worker would receive 75% of the salary, this article deserves a review because if applied, the affected person will have problems even to buy medication. And if this happens, many cases will be judicialized," he added.

Furthermore, he insisted that "laws cannot have retroactive effect, for example in cases of dismissal, the new norm is applied." Regarding the controversy over overtime, he stressed that "it is a fiction. The overtime bank has existed since 1991."
